Representative Experience:
• Exxon Valdez Oil Spill Litigation –
Representing the Administrator of the Exxon Qualified
Settlement Fund, overseeing the disbursement of the
class action plaintiffs’ damage awards against
Exxon Corporation, resolving creditor disputes over
the priorities of liens, levies, assignments, and other
interests in the various plaintiffs’ allocations
and recoveries;
•
Health Maintenance Centers/Znetix Receivership Action
– Represented the court-appointed receiver in
various aspects of this federal receivership case, including
asset recovery, real estate transactions, and estate
administration for the benefit of creditors;
•
Omega Environmental, Inc. – Debtor-in-possession
representation on a wide variety of issues and tasks
in this large Chapter 11 case for a nationwide contractor
and petroleum remediation company, including debtor-in-possession
financing, asset sales, environmental cleanup and liability
issues, real estate contractor and other lien disputes,
the prosecution of hundreds of preferential transfer
actions against contractors across the country, and
general case administration;
•
Troubled loan litigation and workouts for lenders and
loan servicing companies, including real estate mortgage
loans, deeds of trust, and foreclosures, unlawful detainer
actions, and various aspects of banking, lending, and
debt collection laws and regulations;
•
Negotiating, drafting, and enforcing business contracts
and asset purchase agreements, both in and out of the
bankruptcy context;
•
Creditor representation in a variety of contexts, including
asset recovery, workouts, lien priority disputes, foreclosures,
replevins, executions, attachments, garnishments, bankruptcies
and receiverships;
•
Trial experience in various consumer and commercial
lending disputes, political asylum and immigration litigation,
criminal defense, child dependency and parental rights
termination trials.
